When might you need to pursue a claim?

 

If your new home suffers from major defects and the developer and/or new home warranty provider fail or refuse to put things right properly or at all, legal action may be necessary. The cost of putting right unresolved defects in new build homes can be huge. That is what you would be claiming for. If you don't, you could end up paying for repairs yourself or living in substandard or deteriorating accommodation.


Legal action gives you an effective bargaining position from which to negotiate and insist on a proper fix. Claims by homeowners against housebuilders and developers very rarely make it to trial. Most settle early.
